About this deal

The legal position remains: there is no case to answer (nor could a jury properly convict) for the offences of murder or manslaughter where the prosecution cannot prove who killed the victim. In a case where there is more than one such suspect and the section 5 offence is charged, it may in addition be appropriate to charge the suspects with murder or manslaughter. If a defendant pleads not guilty to murder but guilty to manslaughter without that appearing as a count on the indictment, that plea is a nullity if the prosecution does not accept it. The defendant cannot be sentenced for it in the event of acquittal on the count of murder. It should therefore, as suggested above, be put to the defendant on a two-count indictment; if the defendant pleads guilty to the second count of manslaughter, it is the first count on which the defendant can then be tried by a jury: Hazeltine [1967] 2 QB 857; Yeardley [2000] 2 WLR 366.

Deborah Riscoe is one of Dalgliesh's romantic interests; they first meet when a murder shakes Riscoe's home in Cover Her Face; their relationship develops over the course of A Mind to Murder. However, because of Dalgliesh's reluctance to commit, Riscoe ends their relationship via a letter at the conclusion of Unnatural Causes, accepting a transfer to the United States of America. The writing I thought was good, but honestly the flow was off. I think the book needed to be edited a bit tighter since we tended to wander around in some of the characters story-lines way too long. For example, the whole thing with Frederica was one of those story-lines.Dalgliesh lives in an existential funk. Of course, we all do, but many of us are able to keep the confusion, dread and sorrow of life at bay. Not him, not so much. Dalgliesh is human. The subject of all literature is the human being. In A Mind to Murder, James is already grappling with the questions at the heart of human existence. The suspect reported the death to the police and fully assisted them in their enquiries into the circumstances and their part in it.

An objective test (the third component): A person of D's sex and age, with a normal degree of tolerance and self-restraint and in the circumstances of D, might have reacted in the same or in a similar way to D. I didn't like this one as well as the first in the series. I did like Dalgliesh himself, and I learning a few more facts about his life, and the way he thinks. I also liked solid, reliable Inspector Martin. But the supporting cast of characters was less interesting. I was less interested in the the staff of a psychiatric clinic than a small group of family and friends in a country village. In fact, I was only mildly interested in a couple of the doctors (Dr. Steiner and Dr. Saxon), but they aren't really major characters. Not a bad read, and I would recommend it to people who read British mysteries or who have decided they want to read this series. The victim did not have the capacity (as defined by the Mental Capacity Act 2005) to reach an informed decision to request another to end their life;
